Forfeit Bond
Summary
This option is used to forfeit a bond, especially a Surety bond that a bonding company must pay on behalf of the defendant.
Criminal
Forfeit Bond
Step 1: Select Process
- After opening the Criminal folder, Select Criminal Cases
- Find and open case with bond. Select Bonds from the Options list.
- Double Click on the bond to open bond.
Step 2: Locate the Tasks options you can perform on the posted bond.
- Select Forfeit Bond
- Select the reason for the forfeiture from available drop down options.
- Enter the Forfeiture Notice Date. Use the Forfeiture Notice hyperlink to select a date from the calendar.
- Enter the Forfeiture Date. Use the Forfeiture date hyperlink to select a date from the calendar.
- Enter the Amount to Forfeit located next to the Bond Balance.
- In the Fee section the system will display all cases this defendant owes.
- Expand fees to add the bond forfeiture. Felony Bond Forfeiture will create a disbursement payable to the Department of Revenue. Misdemeanor Bond Forfeiture will create a disbursement payable to the County Trustee.
- Enter the amount of the forfeited bond in the total assessed field. If fees are expanded enter the amount to apply-fee by fee for the forfeited bond amount.
- Total amount to forfeit must equal Total Amount Applied to be able to continue.
Step 3: Enter the Receipt Information.
Step 4: An automatic rule docket entry is generated. Make any changes if needed.
Step 5: Completing Bond Information will display. Verify information. Click Finish.
Step 6: After completing the Forfeit Bond, your bond will be closed.
Voiding a Bond That Has Been Forfeited
Step 1: If a bond was forfeited in error, you will double click on the closed bond. Click on the Activity Tab.
Step 2: Double-click on the Forfeit activity line.
Step 3: This opens the Bond Forfeit. At the bottom left-hand corner is the Void Bond Forfeit.
Step 4: Clicking on this hyperlink will bring up the Void Transaction. Enter the information on the screen and click Next.
Step 5: Completing Voiding a Transaction will appear- Click Finish-the void will reverse the accounts and put it back to its original state.
